Your use of this software indicates your acceptance of this License Agreement and warranty. Piranha Feed is Copyright (C) 2002-2004, Answers 2000 Limited. DEFINITIONS The following definitions shall apply in this document: "ANSWERS 2000": Answers 2000 Limited, 16 Willow Chase, Hazlemere, High Wycombe, HP15 7QP, United Kingdom. "Piranha Feed": this software package, used for interfacing with the XML interface with Amazon.com's associates program, property of ANSWERS 2000. "USER": You - any person or entity who has purchased a license to use "Piranha Feed". LICENSE ENTITLEMENT 1. The purchase of one license for Piranha Feed entitles the user to install and use Piranha Feed on all of USER's web site(s) that use a common Amazon.com associate ID. In the event the USER has multiple Amazon.com associate IDs, the USER should purchase one Piranha Feed License for each each Amazon.com associate ID they wish to use the Piranha Feed with. DISTRIBUTION 1. This software may not be distributed by any party other than Answers 2000 Limited. 2. USER may not redistribute, resell or sublicense Piranha Feed or any component thereof. REVERSE ENGINEERING / MODIFICATION 1. No component part of Piranha Feed may be disassembled or reverse engineered. 2. USER is authorised to make configuration changes, as specified in the documentation in order to customise the appearance and functionality of Piranha Feed. PUBLICATIONS INCORPORATING PIRANHA FEED 1. Piranha Feed is designed to integrate into USER's web site(s) and publish information in HTML and other formats. 2. USER is authorized to upload Piranha Feed to all USER's web site(s) that use a common Amazon.com Associate ID. 3. USER will take reasonable precautions to ensure that Piranha Feed source code installed on USER's web site can not be accessed, downloaded or copied by third parties. 4. USER agrees only to use Piranha Feed only on web sites that fully comply with law. USER agrees to indemnify ANSWERS 2000 against any legal action brought against ANSWERS 2000 as a result of the USER's or USER's web site content, violating any law or contract. RELATIONSHIP WITH AMAZON 1. While Piranha Feed uses Amazon.com's XML and other interfaces and is intended to assist members of Amazon's associates program, this product has not been endorsed by Amazon.com. 2. ANSWERS 2000 is not responsible for the operation of Amazon.com's associate program, web site, XML feeds, etc., and disclaims all liability and responsibility for errors, problems, modifications, etc., arising from Amazon.com's associate program, web site, XML feeds, etc. 3. USER is solely responsible for the operation of USER's web site, including conduct of their business relationship with Amazon.com's associate program, and compliance with any and all terms and conditions specified by Amazon.com's associate program. 4. USER will not use Piranha Feed in conjunction with any web site that, or in any manner that, violates any of the terms and conditions of Amazon.com's associate program. 5. ANSWERS 2000 does not make any warranties regarding the performance or accuracy of any hyperlinks, including Amazon.com Associate hyperlinks, that Piranha Feed may generate to Amazon.com. USER accepts full responsibility for ensuring all such hyperlinks are correctly coded, operate correctly, and are tracked correctly (for Associate commission-earning or other purposes) by Amazon.com. USER further accepts full responsibility for ensuring all such hyperlinks are in accordance with all guidelines, terms, procedures or other information that Amazon.com may publish. 6. In the event of errors in hyperlinks, or any other technical problems that (1) result in lost or reduced opportunities to earn Amazon.com Associate commissions, or (2) result in lost or reduced commission rates from the Amazon.com Assocate program: USER agrees to waive all claims against ANSWERS 2000 relating to such losses. NO LIABILITY, NO WARRANTIES 1. In no event will ANSWERS 2000 be liable to any party for any direct, indirect, punitive, special, incidental or other consequential damages arising directly or indirectly from any use of Piranha Feed, even if ANSWERS 2000 is expressly advised of the possibility of such damages. 2. This software is provided "as is" and without warranties as to performance of, merchantability or any other warranties whether expressed or implied. The USER assumes the entire risk of using this software, and publishing web sites that incorporate information generated by the software. 3. Even if these limitations are found not to apply, the maximum liability of ANSWERS 2000 will be limited to replacement of this software product or refund of the purchase paid to ANSWERS 2000 by the USER, according to ANSWERS 2000's preference. PRODUCT SUPPORT 1. No formal product support is provided, but USERs are encouraged to send questions, comments or suggestions to ANSWERS 2000 by e-mail or by writing. COMMENT 1. Any comments or materials sent to ANSWERS 2000 regarding the ANSWERS 2000's web sites, Piranha Feed or any of the ANSWERS 2000's products or services may be used by ANSWERS 2000 without liability, and without compensation or attribution to the sender. ANSWERS 2000 may reproduce, use, disclose, exhibit, display, transform, create derivative works and distribute such content or materials to others without limitation. LINKS TO OTHER WEB SITES 1. Information on ANSWERS 2000's web sites, the documentation provided with Piranha Feed may contain links or references to other sites. Other sites may contain links or references to ANSWERS 2000's web sites, products or services. ANSWERS 2000 does not endorse, and is not responsible for, any product or service offered by any entity other than itself. UNSOLICITED E-MAIL AND MESSAGING 1. USER agrees not to use any form of unsolicited e-mail or unsolicited messaging, to promote any web site that makes uses of Piranha Feed. 2. USER agrees not to make any reference to Piranha Feed, ANSWERS 2000, or any of ANSWERS 2000's products or services, in any form of unsolicited e-mail or unsolicited messaging. INTERNET NEWSGROUPS (USENET) 1. USER agrees not to use inappropriate, or off-topic, postings to Internet newsgroups (Usenet) to promote any web site that makes uses of Piranha Feed. 2. USER agrees not to make inappropriate, or off-topic, postings to Internet newsgroups (Usenet) that make any reference to Piranha Feed, ANSWERS 2000, or any of ANSWERS 2000's products or services. 3. A Usenet news article shall be considered inappropriate if does not fully comply with the written charter/FAQ of the newsgroup to which it is posted. The USER is responsible for determining the rules of a newsgroup before posting to it. 4. Established Usenet conventions ("Netiquette") prohibit advertising in most Usenet newsgroups. USER may post advertisements only in those newsgroups that specifically permit them in the charter or FAQ. Some newsgroups may permit "classified ads" for single transactions between private individuals, but not commercial advertisements. USER is responsible for determining whether or not a newsgroup permits advertisements before posting. GOVERNING LAW 1. This agreement shall be interpreted in accordance with the laws of England. The USER consents to the exclusive jurisdiction of the English courts. The USER agrees that any legal action against ANSWERS 2000, relating to this agreement and/or Piranha Feed will be brought in the courts of London, England.
